You’re Behaving Like A ‘Frustrated Man’ – Lawyer Boamah-Nyarko Slams Kissi Agyebeng

Isaac Boamah-Nyarko, a legal practitioner and Member of Parliament (MP) for Effia, says the Special Prosecutor’s declaration of Ken Ofori-Atta as a “wanted fugitive” is completely “irrational” and “unnecessary”.
To him, the Special Prosecutor is in breach of the country’s laws, stressing, by law, no person can be compelled to forcibly honor an invite.
He explained that before the Special Prosecutor can “force” someone, in this case Mr. Ofori-Atta, to appear before his outfit, he must first secure a court warrant.
He further noted even where a warrant has been obtained, Mr. Ofori-Atta or anybody else, has the right to remain silent, refusing to answer questions from the Special Prosecutor or any State investigative body.
“By law, even when I appear before you, you cannot compel me to speak. The law protects you against self-incrimination…It is your right to give your statement; it is your right to remain silent.”
He also argued that Ofori-Atta doesn’t have to make himself physically available before the Special Prosecutor can commence his investigations, hence finds the “fugitive” label completely “out of the order”.
“You don’t need Ken Ofori-Atta to be physically present before you conduct your investigations because whether he will appear before you or you don’t appear before him, you can continue to do your investigations. All you are doing is that you are building a docket to prosecute”, he established.
He further questioned the Kissi Agyebeng’s logic to declare Ofori-Atta wanted fugitive without officially charging him with any offence.
“Has Ken Ofori-Atta been charged of any offence?”, he queried.
Lawyer Isaac Boamah-Nyarko, on the other hand, questioned Mr. Agyebeng’s competence alluding to the latter failing to win any of the cases pursued by his office.
“Go and win your cases” and stop disgracing people, the MP admonished, stressing the Special Prosecutor is behaving like a “frustrated man”.
“What is his success rate?…How much money has the Special Prosecutor refunded to this country?”, he also asked, adding “it appears even the office that we created has become a nuisance to this State”.
